Higher merger notification thresholds, in force from 1 September!

Having presented the plan to raise the French merger control thresholds, Rive Gauche Avocats looks at the entry into force of Law No. 2026-403 of 26 May 2026 amending the thresholds for notification to the French Competition Authority. It is 1 September!

As a reminder, Article 8 of the bill to simplify economic life, adopted by the National Assembly and the Senate on 14 and 15 April, raises these thresholds: for the main threshold, it is no longer 150 and 50 but 250 and 80.

The Competition Authority stresses that the text is “the result of close work with the government to strike a balance between easing the burden on businesses, particularly SMEs, and the need to review mergers in the interest of consumers.”
